1. Executive Summary

Prohibited Area (P or VTP) as defined in AIP ENR 5.1 refers to airspace where flight operations are strictly prohibited, unless specific authorization is granted by the competent authority.

 

For UAV operators:

 

• VTP is fundamentally a “No-Go” area

• Entering the area without authorization constitutes a violation of aviation regulations

• Misinterpreting it as merely a “sensitive area” can lead to serious legal consequences

 

Operational Summary:

VTP = Absolute No-Fly Zone, unless explicit authorization has been formally granted.

In the AIP ENR 5.1 table, each VTP area typically includes the following key information:

 

  1. Area identification code (e.g., VTPxx)

  2. Geographical boundaries (polygon or circular coordinates)

  3. Vertical limits (e.g., FL240 / GND)

  4. Nature of restriction

  5. Reason or type of activity associated with the restriction

  6. Controlling authority

 

UAV operators should review all fields carefully, particularly the vertical limits and the nature of the restriction, before making any flight decision.

3. Example: Interpreting Information
from the Table

Assume the table indicates:

 

• Upper / Lower Limit: FL240 / GND

• Nature of Hazard: Military Activity

• Permission to Entry: Only authorized aircraft

 

Interpretation:

 

• Flight is prohibited from the ground level up to the specified upper altitude limit

• The area is associated with military activities

• Entry is allowed only for aircraft with official authorization

 

For UAV Operators:

 

If there is no explicit authorization from the controlling authority, conducting a flight in this area constitutes an immediate violation of aviation regulations.

 

Even if the drone is flown at a low altitude, such as 30 meters above ground level, it is still considered within the prohibited airspace if the lower limit is specified as GND (ground level).

4. Legal Interpretation
(Operator Perspective)

Before conducting a flight, operators should verify:

 

  1. Whether the location falls within a VTP (Prohibited Area)

  2. Whether the specified altitude limits cover the intended UAV flight altitude

  3. Whether there are any exemptions or specific authorizations granted

  4. Whether additional NOTAM restrictions are in effect

 

Key Consideration:

 

A VTP is not an area where general permission can be obtained through standard flight apps.

Authorization must follow the specific approval mechanism of the controlling authority responsible for that airspace.

5. Operational Implications
for UAV Operations

5.1 Legal Consequences

 

Flying in a VTP (Prohibited Area) without authorization may result in:

 

• Legal enforcement under aviation regulations

• Suspension or revocation of the UAV pilot permit

• Insurance policies may not cover damages arising from the violation

 

5.2 Common Misunderstandings

 

• “Flying very low should not be a problem”

• “No authorities are present in the area, so it should be safe”

• “The flight app does not show a warning, so the area should be allowed”

Reality

 

If an area is designated as a Prohibited Area in the AIP, it is legally considered a No-Fly Zone under aviation law, regardless of whether a warning appears in consumer drone applications.

6. Pre-Flight Decision Model

Recommended steps before flight:

 

  1. Verify whether the location falls within a VTP (Prohibited Area)

  2. Check the upper and lower altitude limits

  3. Confirm whether specific authorization has been granted

  4. If no authorization exists → Decision: NO-GO

 

Example scenario:

 

If the area is designated as VTP and the vertical limits extend from GND upward, and the UAV operator does not hold official authorization, then:

 

• Final decision: NO-GO immediately

A Prohibited Area (VTP) is an airspace where aviation regulations clearly prohibit flight operations unless specific authorization has been formally granted.

 

For UAV operators:

 

A VTP should be treated as an immediate stop point in flight planning if no official authorization is available.
